Rental Agreement

By completing your reservation and payment, you agree to the following terms.

Equipment Responsibility

You are responsible for all rented totes and equipment from delivery until pickup is completed. All items must be returned in the same condition as delivered, normal wear and tear excepted.

Damage or Loss

Replacement costs:

  • Tote (bin + lid): $10 each
  • Tote dolly: $40
  • Hand truck: $150

Any damaged or missing items will be charged to the card used at checkout.

Late Returns

If items are not ready for pickup on the scheduled date, additional charges may apply:

  • 20 totes: $40 per extra week or $7 per extra day
  • 40 totes: $60 per extra week or $9 per extra day
  • 60 totes: $80 per extra week or $12 per extra day

If you need more time, just let us know.

Pickup Access

All totes must be empty, accessible, and ready for pickup. If not accessible, additional fees may apply.

Proper Use

Totes may NOT be used for:

  • Hazardous materials
  • Liquids without proper sealing
  • Illegal or damaging contents

You are responsible for any damage caused by misuse.

Liability & Assumption of Risk

You use the totes and equipment at your own risk. To the fullest extent allowed by law, Midland Tote Rentals is not liable for any injury, loss, or damage to persons or property arising from or related to your use of the rented equipment, including during loading, hauling, moving, or storage. You are responsible for using the equipment safely and for how it is used by anyone you allow to use it. This section does not apply to any liability that cannot be waived under applicable law.

Non-Return & Replacement Charges

If equipment is not returned within 30 days of delivery and no extension is arranged, it will be considered unreturned, and you authorize Midland Tote Rentals to charge your card for the replacement costs listed above. Returned items after charges may be refunded at our discretion.

Indemnification

You agree to hold Midland Tote Rentals harmless from any claims, damages, or costs arising from your use of the equipment or your breach of this agreement.

Severability

If any part of this agreement is found invalid or unenforceable, the rest of the agreement stays in full effect.
